On this page are details of corrections that need to be made to the 6th edition of the Canons (incorporating the first supplement). Customers who purchase a complete set of the Canons and the first supplement should complete their yellow registration form and return it to this office to receive details of future supplements.
Delete note and substitute "16 November 2005 - promulgation of Amending Canon No.24 (amended Canons C1, C12, C13, C14, C15, C26, G1 and G3).".
In Canon C 1 (of Holy Orders in the Church of England)-
(a) in paragraph 2 the word “finally” shall be omitted;
(b) in paragraph 3 for the words “inferior clergy” there shall be substituted the words “priests and deacons”;
(c) at the end there shall be inserted the following paragraph-
“(4). Where any bishop, priest or deacon ceases to hold office in the Church of England or otherwise ceases to serve in any place he continues to owe canonical obedience in all things lawful and honest to the archbishop of the province or the bishop of the diocese (as the case may be) in which he resides for the time being.”.In Canon C 12 (of the licensing of ministers under seal)-
(a) in paragraph 5 for the words from the beginning to “reasonable after” there shall be substituted the words “Subject to section 7(1A) of the Church of England (Legal Aid and Miscellaneous Provisions) Measure 1988, where a bishop has granted a licence to any minister to serve within his diocese otherwise than as a member of a team ministry, the bishop may revoke the licence summarily, and without further process, for any cause which appears to him to be good and reasonable (other than for misconduct in respect of which disciplinary proceedings may be instituted under the Clergy Discipline Measure 2003) after explaining the reasons for the revocation and”;
(b) for paragraph 6 there shall be substituted the following paragraph-
“6(1) This paragraph applies where a licence has been granted by a bishop to any minister to serve within his diocese for a term of years otherwise than as a member of a team ministry.
(2) The bishop may before the expiration of the term of years by notice in writing request the minister to vacate his office when the term expires.
(3) Where no such request has been made before the expiration of the term of years the minister may continue in office, but the bishop may by notice in writing request the minister to vacate his office at the expiration of the period of three months following the giving of the notice.”.
In Canon C 13 (of the oath of allegiance) in paragraph 1-
(a) for the words from “to any benefice” to “preachership” there shall be substituted the words “, installed, licensed or admitted to any office in the Church of England or otherwise to serve in any place”;
(b) for the words “or licensed” there shall be substituted the words “installed, licensed or admitted”.
In Canon C 14 (of the oaths of obedience)-
(a) in paragraph 1 after the words “suffragan bishopric,” there shall be inserted the words “or who is to be licensed as an assistant bishop,”;
(b) in paragraph 3 the words from “, or to be instituted” to “in any place,” and the words “, instituted, or licensed,” shall be omitted;
(c) in paragraph 4 for the word “thing” there shall be substituted the word “things”;
(d) at the end there shall be inserted the following paragraph-
“5. Every bishop, priest or deacon who is to be translated, instituted, installed, licensed or admitted to any office in the Church of England or otherwise to serve in any place shall reaffirm the Oath of Canonical Obedience or his solemn affirmation taken at his ordination or consecration to the archbishop of the province or the bishop of the diocese (as the case may be) by whom he is to be instituted, installed, licensed or admitted in the presence of the said archbishop or bishop or his commissary in the form set out in this Canon.”.
In Canon C 15 (of the declaration of assent)-
(a) in paragraph 1 for sub-paragraphs (5) and (6) there shall be substituted the following sub-paragraphs-
“(5) Every clerk in Holy Orders who is to be instituted, installed, admitted or licensed to any office in the Church of England or otherwise licensed to serve in any place shall first make the Declaration of Assent in the presence of the bishop by whom he is to be instituted, installed, admitted or licensed or of the bishop’s commissary unless he has been ordained the same day and has made the Declaration.
(6) Where any bishop, priest or deacon ceases to hold office in the Church of England or otherwise ceases to serve in any place the Declaration made under this Canon shall continue to have effect in so far as he continues to minister in the Church.”;
(b) in paragraph 4-
(i) for the words from the beginning to “shall” there shall be substituted the words “Where any minister has been instituted, installed, licensed or admitted to office in some place other than the place where he is to serve he shall”;
(ii) in sub-paragraph (a) the word “licensed” shall be omitted;
(iii) in sub-paragraph (b) for the words “licensed to a stipendiary curacy” there shall be substituted the words “instituted or licensed to serve”.
In Canon C 26 (of the manner of life of ministers) in paragraph 1 for the words “bishop, priest, and deacon” and in paragraph 2 for the word “minister” there shall be substituted the words “clerk in Holy Orders”; and, accordingly, in the heading for the word “ministers” there shall be substituted the words “clerks in Holy Orders”.
In Canon G 1 (of ecclesiastical courts and commissions)-
(a) in the opening sentence after the words “Ecclesiastical Jurisdiction Measure 1963” there shall be inserted the words “and the Clergy Discipline Measure 2003”;
(b) in paragraph 1 the words from “of offences” to “also” shall be omitted and at the end there shall be inserted the figure “1963”;
(c) after paragraph 1 there shall be inserted the following paragraph-
“1A. A tribunal for the diocese in question (to be called the bishop’s disciplinary tribunal) for the hearing of disciplinary proceedings against a priest or deacon not involving matters of doctrine, ritual or ceremonial as provided in the Clergy Discipline Measure 2003.”;
(d) in paragraph 2-
(i) in sub-paragraph (a) at the end there shall be inserted the figure “1963”;
(ii) for sub-paragraph (b) there shall be substituted the following paragraph-
“(b) the Vicar-General’s court constituted in accordance with the Clergy Discipline Measure 2003 for the hearing of disciplinary proceedings against a bishop or an archbishop not involving matters of doctrine, ritual or ceremonial as provided in that Measure,”;
(e) in paragraph 3 sub-paragraph (b) shall be omitted;
(f) in paragraph 4 the words from “or of any” to the end shall be omitted;
(g) after paragraph 4 there shall be inserted the following paragraph-
“4A.The Arches Court of Canterbury and the Chancery Court of York have jurisdiction to hear appeals from the bishop’s disciplinary tribunal referred to in paragraph 1A above and from the Vicar-General’s court constituted as mentioned in paragraph 2(b) above.”.
In Canon G 3 (of the judges of the Arches Court of Canterbury and the Chancery Court of York) in paragraph 2 at the end there shall be inserted the following sub-paragraph-
“(d) the others are all the diocesan chancellors appointed under section 2 of the Ecclesiastical Jurisdiction Measure 1963 except the chancellor of the diocese of Gibraltar in Europe.”.
